At the instance of Benjamin Gwinn and the request o fBenjamin Douglass of the one part, and Samuel Smith and John Rose of t heother part, I have resurveyed a tenement or parcel of land, being th atpart of two tracts of land in CC, the one called Stumpdale, the othe rcalled Brants Discovery, formerly laid out for Philip Jenkins in a division made between sd Philip Jenkins, John Jenkins, & John Chandler, and do find that 20 acres thereof lies within an elder survey called Lee sPurchase, the sd part, exclusive of sd Lees Purchase, being bounded b ysd Brants Discovery, containing 55 acres, and have divided the same i ntotwo equal parts, the westernmost part going to sd Benjamin Douglass , andthe other part going to sd Samuel Smith and John Rose. I also cer tifythat I have divided the easternmost part into 3 equal parts betwee n thesd Samuel Smith, - John Rose, and Ann Jenkins, relict of the afd P hilipJenkins, each part containing 9 acres and one sixth part of an ac re,with the southernmost part for sd Ann Jenkins as her right of dower , thenorthernmost part for sd Samuel Smith, and the middle part for th e sdJohn Rose. Resurveyed & divided Jan 24, 1765 per Will Hanson Deput ySurveyor: Benja Douglass - 27, Samuel Smith 9 1/6, John Rose 9 1/6, A nnJenkins 9 1/6, the whole, 55. [A plat follows]. Page 640. Mar 20, 1765 from Samuel Smith and Sarah Smith, of CC, to Benjamin Gwinn of Stafford County, Virginia, Gentleman. A certain Philip Jenkins of CC, died seized of part of a tract of land called Stump Dale and part of another tract of land called Brents Discovery, which sd lan dwas divided between the afd Philip Jenkins, John Jenkins, and John Chandler, which division is recorded in CC, and which sd land, after his death, became the right of his son, John Jenkins, and he afterwards died ,after whose death the land afd became the right of John Rose, Mary Ro se,Samuel Smith, Sarah Smith, which sd Mary Rose and Sarah Smith were daughters to the afd Philip Jenkins and the sd Samuel Smith and John Ros eafterwards had a division of part of the afd tracts of land, which division remains on the records of CC. Now this deed witnesses that the s dSamuel Smith and Sarah Smith, for 19 £ 10 shillings and for divers ot hergood causes, sell to sd Benjamin Gwinn, all their moiety or half pa rt oftwo tracts of land in CC, the one called Stump Dale, the other Br antsDiscovery, containing and laid out for about 13 acres.
